

(At Least) Momentary Good News for DACA!
In case you have not heard, on Tuesday, April 24, 2018, in National Association for the Advancement of Colored People v. Trump, the U.S. District Court Judge for the District of Columbia, Judge John Bates, ordered that the Trump Administration's decision to rescind DACA be vacated (this would require the reinstatement of DACA including the acceptance of applications from new DACA applicants). Judge Bates based his decision on the Trump Administration's lacking justification


Residual Clause of "Crime of Violence" under "Aggravated Felony" Voided for Vagu
It was decided today in the reargued case of Sessions v. Dimaya that the residual clause defining "a crime of violence" where there is a penalty of imprisonment of at least one year (18 USC 16(b)) under an "aggravated felony" (INA 1101(a)(43)(F)) is unconstitutional as it violates the Due Process Clause of the 5th Amendment and should be voided for vagueness.
